These Terms and Conditions ("Agreement") govern your access to and use of the website located at www.BainbridgeAdventures.com (the "Site") and all services, tours, and experiences offered by Bainbridge Adventures ("Bainbridge Adventures," "we," "us," or "our"). By accessing the Site or booking any service, you confirm that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree, you must discontinue use of the Site and our services immediately.

We reserve the right to amend this Agreement at any time. Your continued use of the Site following any posted changes constitutes acceptance of those changes. We encourage you to review this page periodically.

1. Eligibility

Our Site and services are intended for individuals who are 18 years of age or older. By accessing the Site or booking a service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are booking on behalf of a minor, you represent that you are the minor's parent or legal guardian and accept responsibility for compliance with this Agreement on their behalf.

2. Bookings and Reservations

All bookings are subject to availability. We reserve the right to decline or cancel any booking at our sole discretion. Confirmation of a booking does not guarantee availability until we have confirmed receipt and acceptance of your reservation.

2.1 Group Bookings

For groups larger than twelve (12) participants, you must contact us in advance to confirm vehicle and capacity availability. Group bookings made without prior confirmation may be subject to modification or cancellation.

2.2 Age-Based Pricing

The following age-based pricing applies to all bookings:

• Infants (age 3 and under): No charge.

• Children (ages 4 through 12): Discounted rate. Please contact us for current pricing.

• All other participants: Standard adult rate.

You are responsible for accurately representing the ages of all participants at the time of booking. Misrepresentation may result in additional charges or cancellation.

3. Cancellation and Refund Policy

You may cancel your booking for a full refund provided that cancellation is received at least 48 hours before your scheduled activity start time. Cancellations received less than 48 hours in advance are not eligible for a refund.

To cancel a booking, you must submit a written cancellation request by email to bainbridgeadventures@gmail.com. Cancellations are effective only upon our written confirmation. Verbal cancellations will not be accepted.

We reserve the right to cancel or reschedule any activity at our discretion. In the event we cancel an activity, you will be offered a rescheduled date or a full refund. We are not responsible for any incidental, consequential, or indirect costs incurred by you as a result of a cancellation or rescheduling on our part, including but not limited to travel expenses, accommodations, or lost wages.

4. Weather Policy

Many of our experiences require suitable weather conditions for safe and enjoyable operation. We reserve the sole right to determine whether weather conditions are adequate to proceed with a scheduled activity. In the event an activity is canceled due to weather, you will be offered a rescheduled date or a full refund. No additional compensation will be provided for weather-related cancellations.

We strongly recommend that all guests monitor forecasts and plan accordingly. We are not responsible for weather conditions or their impact on your travel plans or experience.

5. Accessibility

Our tours and experiences are not currently wheelchair accessible. It is your responsibility to assess your physical capabilities and any limitations before booking. By completing a booking, you represent that you have considered your personal circumstances and determined that participation is appropriate for you.

6. Travel Insurance

We strongly recommend that all participants obtain comprehensive travel insurance prior to booking. Travel insurance may cover trip cancellation, interruption, medical expenses, and other unforeseen circumstances. Bainbridge Adventures is not responsible for any losses you incur as a result of failing to obtain adequate travel insurance coverage.

7. Assumption of Risk, Release, and Waiver of Liability

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

7.1 Assumption of Risk

You acknowledge and understand that participation in tours, transportation services, outdoor activities, and adventure experiences involves inherent risks, including but not limited to: weather conditions, terrain hazards, wildlife encounters, physical exertion, vehicle travel, and other unforeseen hazards. You voluntarily assume full responsibility for any and all risks of loss, property damage, personal injury, or death that may result from participation in any activity offered by Bainbridge Adventures, whether or not caused by the negligence of Bainbridge Adventures or its personnel.

7.2 Release and Waiver

In consideration of being permitted to participate in activities offered by Bainbridge Adventures, you hereby release, waive, discharge, and covenant not to sue Bainbridge Adventures, its owners, directors, officers, employees, agents, contractors, and volunteers (collectively, the "Releasees") from any and all claims, demands, actions, causes of action, and liabilities of any kind arising out of or related to any loss, damage, personal injury, or death that you may sustain while participating in any activity, or while on any premises associated with such activities, whether or not caused by the negligence of the Releasees.

This release applies to claims arising under any legal theory, including negligence, strict liability, breach of contract, and breach of any statutory duty.

7.3 Indemnification

You agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your participation in any activity; (b) your breach of this Agreement; (c) your violation of any applicable law or regulation; or (d) any act or omission by you or any person traveling with you.

7.4 Medical Treatment Consent

In the event of injury, illness, or accident during any activity, you consent to receive such emergency medical treatment as may be deemed necessary or advisable by medical or emergency personnel. You acknowledge that you are solely responsible for all costs associated with any medical treatment, transportation, or evacuation, and that Bainbridge Adventures bears no financial responsibility for such costs.

7.5 Fitness to Participate

By completing a booking and participating in any activity, you represent and warrant that you are in good physical health, are physically fit and capable of participating in the booked activity, and have not been advised by a qualified medical professional to avoid such activity. It is your sole responsibility to consult with a physician if you have any doubt about your fitness to participate.

8. Photography and Media Release

By participating in any activity, you grant Bainbridge Adventures a perpetual, royalty-free, worldwide, non-exclusive license to use your image, likeness, voice, and any photographs or recordings taken during your participation for marketing, promotional, and commercial purposes across any media, including digital and social media platforms, without further compensation or notice to you.

If you do not wish to be photographed or recorded, you must notify us in writing prior to your activity. We will make reasonable efforts to accommodate your request, but cannot guarantee that you will not appear incidentally in group photographs or recordings.

9. Intellectual Property

Unless otherwise stated, Bainbridge Adventures owns or holds a license to all intellectual property rights in the Site and its content, including but not limited to text, images, audio tour content, graphics, logos, and design (collectively, "Content"). All rights are reserved.

You may access and use the Content for personal, non-commercial purposes only. You must not:

• Copy, reproduce, republish, or redistribute any Content without prior written permission

• Sell, rent, sub-license, or otherwise transfer any Content to any third party

• Use any Content for commercial purposes without our express written consent

• Remove or alter any copyright, trademark, or proprietary rights notices

Any unauthorized use of the Content may constitute a violation of applicable copyright, trademark, or other intellectual property laws and may result in civil or criminal liability. Infringements will be addressed pursuant to the Digital Millennium Copyright Act (DMCA) and applicable law.

You grant Bainbridge Adventures a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, distribute, and display your submitted content in any form or medium.

Bainbridge Adventures reserves the right to monitor, remove, or decline to publish any user-submitted content that we determine, in our sole discretion, to be inappropriate, offensive, or in violation of this Agreement, without notice or liability to you.

12. Hyperlinking Policy

The following types of organizations may link to our Site without prior written approval: government agencies, search engines, news organizations, and online directory distributors linking in the same manner as they link to other listed businesses.

All other organizations wishing to link to our Site must submit a written request to bainbridgeadventures@gmail.com including: your name, organization name, contact information, the URL of your site, a list of URLs from which you intend to link to our Site, and a list of the URLs on our Site to which you wish to link. Please allow 2 to 3 weeks for a response.

All permitted links must not be deceptive, must not falsely imply sponsorship or endorsement by Bainbridge Adventures, and must fit the context of the linking site. No use of Bainbridge Adventures' logo or branding is permitted for linking purposes without a separate trademark license agreement.

We reserve the right to revoke linking permission at any time and to require removal of any links to our Site.

13. Content Liability and Third-Party Links

We are not responsible for the content of any third-party websites linked to or from our Site. Links to third-party sites do not constitute an endorsement, sponsorship, or recommendation of those sites or their content. You access third-party sites at your own risk and subject to their own terms and policies.

You agree to defend, indemnify, and hold harmless Bainbridge Adventures from any claim arising out of content appearing on your own website that links to or references our Site, including any claim that such content is libelous, obscene, or otherwise unlawful.

14. Vehicle Cleaning and Safety Protocols

All Bainbridge Adventures vehicles undergo a full hard-surface disinfection before each trip. Hand-sanitizing products are available in all vehicles for passenger use. We reserve the right to update our cleaning and safety protocols at any time in response to applicable health guidance or operational requirements.

15. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAINBRIDGE ADVENTURES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SITE, ITS CONTENT, OR THE SERVICES PROVIDED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.

16. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws provisions. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Kitsap County, Washington, and you hereby consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to contact us in good faith at bainbridgeadventures@gmail.com in an effort to resolve any dispute informally.

17. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of this Agreement shall remain in full force and effect.

18. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Bainbridge Adventures with respect to your use of the Site and services, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
